Terms & Conditions for John Frieda Shampoo Bar Competition

1.  Eligibility: This promotion is only open to UK residents aged 18 years and over. Employees (and their immediate families) of KAO (UK) LIMITED (the “Promoter”), or their respective subsidiaries or affiliated companies or any other persons professionally connected with the competition are not eligible to enter.
 
2.  To Enter.  To enter the competition, participants must:
a)        follow the Instagram accounts @johnfriedauk; and
b)       tag a friend (with a valid Instagram account and handle) in the comments section below the post on Instagram promoting this competition (“Competition Post”) (together the “Entry Content”).

3.   No purchase is necessary, however internet access and a valid Instagram account is required.
4.  Entries are accepted from the time the first Instagram post promoting the competition goes live via @johnfriedauk and entries will close at 11.59pm (GMT) on Monday 29th November 2021 (“Closing Date”).
5.  Each person can enter multiple times but must tag a different friend each time for each entry to be valid.
6.  One (1) winner shall be selected at random by the Promoter from all valid entries received during the competition period containing the correct Entry Content and announced by the Promoter via Instagram account @johnfriedauk on Tuesday 30th Novemeber 2021.
7.  The Prize: The winner will receive the following prize pack:
- One (1) bundle of John Frieda Moisturising Shampoo Bars (x 12)
- One (1) bundle of John Frieda Volumising Shampoo Bars (x12)
Prize is subject to availability. If due to unforeseen circumstances the Prize (or any part of it) is not available, the Promoter reserves the right (but is not obliged) to substitute the prize (or any part of it) for item(s) of equal or higher value. The Promoter accepts no liability for any disappointment caused due to failure to redeem the Prize or any substitution or unavailability of the Prize or any part of it. The Prize cannot be redeemed, refunded, re-sold or exchanged for cash or any other product. Products included in the Prize may contain allergens. The Promoter shall not be responsible for any adverse effects resulting from any products contained within the Prize. Any products forming part of the Prize which are manufactured or supplied by a third party shall be subject to such third party’s own terms and conditions and Promoter shall have no liability with regard to any actual or suspected damage or defects with such products.
8.  The selected winner shall be notified by the Promoter via a direct message to their Instagram account used to submit the Entry Content, advising them of their prize and the steps required to claim their prize. Participants should ensure their Instagram settings permit direct messages of this nature to be received. Promoter does not accept any responsibility for messages not received by the winner.
9.  In the event that the Promoter cannot for any reason contact a prize winner within 48 hours of first attempting to do so, the Promoter reserves the right to select another winner from all valid entries received before the Closing Date.
10.  For the avoidance of doubt, the prize does not consist of anything other than expressly set out in section 7 above and no additional prizes are included.
11.  Winner is responsible for all applicable taxes and expenses save for any postage costs in shipping the Prize to the winners which shall be borne by the Promoter.
12.  By submitting Entry Content, you are agreeing to be bound by these terms and conditions and that you are over 18 years of age.
13.  The Promoter will not be liable for entries not received, incomplete, delayed or damaged or any network failure.
14.  The Promoter reserves the right to disqualify any participant who acts in a manner contrary to the spirit or intention of the competition or otherwise submits Entry Content that is obscene, offensive, derogatory, illegal or otherwise inappropriate, which shall be determined by the Promoter in its sole discretion.
15.  The Promoter reserves the right to publish the names and Instagram profile details of the winner and you provide the Promoter with permission to do this without incurring any form of liability to you as a result. If you object to any or all of your name and winning entry being published or made available, please contact the Promoter at the details provided at section 25. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority if requested.
16.  All participants hereby irrevocably and unconditionally assign to the Promoter with full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any information or other material including without limitation, the participants’s name, entry, photograph, likeness, biographical information, voice, text, images, designs, audio and/or video clips submitted in entering or any statement made by them concerning the competition throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.
17.  The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (which they must provide within 2 days or as otherwise specified by the Promoter) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotions entry requirements or otherwise where an participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter in any decisions, and these will be binding and no correspondence will be entered into
18.  In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
19.  This promotion is in no way sponsored, endorsed or administered by, nor associated with Instagram. You understand that you are providing information to the Promoter and not to Instagram. The information you provide will only be used for fulfilment of this promotion unless you have agreed to its use for any other purpose. By entering the promotion, all participants agree to a complete liability release for Instagram.
20.  The Promoter does not guarantee continuous uninterrupted or secure access to Instagram. Numerous factors outside the control of the Promoter may interfere with the operation of Instagram. No responsibility will be accepted for any difficulties in entering or any entries delayed or corrupted.
21.  The Promoter and its associated agencies and companies will not be liable to any prize winner for any loss (including, without limitation, indirect, special or consequential loss, or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with this promotion, or accepting or using a prize.
22.  The Promoter reserves the right to select an alternative winner in the event that the Promoter has reasonable grounds for believing that a selected winner has contravened any of these terms or has contravened any of Instagram’s Terms of Use. Any alternative winner will be selected applying the same criteria as that used to select the original winner.In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
23.  All entries must be made directly by the person entering the promotion. Bulk, third-party or entries made online using methods such as a macro, a script or the use of automated devices or processes are not allowed, and all such entries shall be disqualified.
24.  Data Protection: The Promoter will only process your personal information as set out in the Kao Group Privacy Policy and only for the purposes of running the prize draw and administration of the prize.
25.  The promotion will be governed by laws of England and Wales and the jurisdiction of the Courts of England and Wales.
